Welcome to Continent 5 Media Group, Inc. (“C5M”). These General Terms of Use (the “Terms”) govern your access to and use of all platforms, services, and programs operated by C5M, including but not limited to Impact Records, Decade 2 Publishing (d2p), KleverBook™, Titan Mobile Gaming, Gallery Aurora, eMoney Network, GreenGenie, and any related services or applications (collectively referred to as the “Services”). By accessing or using any of the Services, you (“User”) agree to be bound by these Terms.
1. Scope
1.1. These Terms apply to all Users of C5M’s Services, regardless of the specific platform or program being used.
1.2. Additional terms may apply to specific platforms. Where applicable, those terms are incorporated by reference.
1.3. By accessing any Services, you acknowledge that you have read, understood, and agree to these Terms.
2. Eligibility
Users must be at least 13 to access C5M’s Services. Users under 18 must have parental or guardian consent.
3. User Accounts
Users may be required to create an account to access certain features. Users agree to provide accurate information and are responsible for maintaining the confidentiality of their account credentials.
4. Acceptable Use
Users agree not to engage in unlawful, fraudulent, or harmful activities. You may not interfere with the operation of the Services or access them using automated means.
5. Impact Records — Music Sales
Impact Records is the music division of C5M. The following terms apply specifically to music purchases:
(a) All music sales are final. Digital downloads are non-refundable once delivered.
(b) Physical products (CDs, vinyl records) may be returned within 14 days if defective or damaged during shipping.
(c) Digital purchases include a download token valid for 30 days with up to 5 downloads.
(d) Purchased music is for personal, non-commercial use only. Redistribution is prohibited.
(e) 30-second song previews are provided for sampling purposes only and may not be recorded or redistributed.
6. Artist Commission Structure
A commission fee of 12% is deducted from all music sales. Artists who elect to participate in C5M’s eMoney program pay a reduced commission of 6%.
Payouts are initiated when an account balance reaches or exceeds $50.00 USD.
7. Intellectual Property
All content on the Website, including design, code, text, graphics, and music, is owned by C5M or its licensors. CONTINENT 5 MEDIA (‘C5M’), Impact Records, and their logos are trademarks of C5M.
8. Disclaimer
THE INFORMATION, CONTENT, AND DOCUMENTS AVAILABLE FROM OR THROUGH THE WEBSITE ARE PROVIDED “AS-IS,” “AS AVAILABLE,” WITH “ALL FAULTS,” AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED.
9. Limitation of Liability
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF C5M AND AFFILIATED PARTIES EXCEED ONE HUNDRED DOLLARS ($100.00).

11. Governing Law
This Agreement shall be governed by the laws of the State of Nevada. Venue shall be exclusively limited to courts in Clark County, Nevada.
